Even though the brothers of dead hedge fund manager and CNBC talking head Seth Tobias have settled with widow Filomena Tobias and sorted out the future of Tobias' $25 million estate, they refuse to retract allegations that she killed their loved one back in September when he was found drugged up in his pool. "There will be no retraction of the allegations," says their attorney. "I would not say that the Tobiases don't believe that she killed him." And that statement comes after the settlement was reached, which means only one thing: Filomena had a crappy ass attorney. Most settlement agreements like this one include clauses about non-disclosure and non-disparagement, which means neither party can publicly reveal the terms of the settlement nor take the other's good name to the pavement. Billy Ash, the self-professed expert and know-it-all in the maybe-murder/maybe-suicide of CNBC contributor Seth Tobias, is much the subject of New York magazine's cover story this week. He's also been keeping in touch with Jossip, going so far as to submit a copy of his video deposition, in which he chokes up at the thought of Tobias' wife, Phyllis, killing his former boss. (Tobias claims to be his former assistant.)

For obvious reasons – including his six month stint in prison, in 1997, for running a prostitution ring and various other illicit activities – Ash's credibility has been questioned. Namely, by New York's Stephen Rodrick.

"I asked Ash if he could provide a snapshot or any other evidence to back up his claim that he and Seth Tobias had ever met," writes Rodrick. "I asked him if I could see the photos of Tobias taken the day he died. He tugged at his cap and shifted his weight. 'You really need to call Debra and make a proposal.' He wanted money before speaking to me further. 'I’m only telling you one percent of it. Make a good proposal, and I’ll tell you more.'"

Well, Ash didn't ask us for any money, but he did provide a photo of Tobias supposedly taken the day he died. It's yours, after the jump.

If you believe New York magazine's feature story this week, the Seth Tobias Death Scandal Ultimate Source, Billy Ash, might be swindling the press.

But does that really matter when he's so kind in sending over a videotape of his deposition? If only this were an episode of Moment of Truth, and some color-coded wires and a circa-80s-printer could tell us if he was lying. Brace yourself, there are tears at the end.

And Not only is Ash a maybe-prostitute solicitor and a maybe-serial liar, he might be stuffing our inbox with falsehoods. What's more egregious than that?

William Ash, former assistant to the late hedge funder, CNBC talking head, and exotic male dancer enthusiast Seth Tobias, writes in to Jossip with news of the on-going battle over culpability:

"The toxicology report came back last week and Seth had booze, coke and a large amount of crushed Ambien in his system. The Jupiter police sent all there paper work to the D.A.’s office yesterday, February 7. They expect a fast turn around on this case. Phyllis [Filomena, the now-widow] hurried and canceled her deposition in probate thinking an arrest is coming and they don't want her under oath making statements that can be used in a criminal case. My deposition went great. I told the same story I told the police almost 5 months ago. Filomena’s camp has been striking out.

"More witnesses have been coming forward that the police know about because Jay Jacknin has been so mean in his attacks. I believe Filomena killed Seth Tobias. Everything points in that direction. I know in my heart that she did it. I believe in an after life. I know Seth Tobias and there is NO way he’s going to forgive or let Filomena get away with killing him. Seth’s mother deserve justice. My story has been the same since day one. Jay Jacknin will say and do anything to protect his 3rd wife Filomena who at one point he had to get a restraining order against because he thought she’d kill him. He said she was addicted to coke, cheating, spending to much money and abusive. Look at the facts and the facts look like she killed him."

HAIR TODAY, GONE TOMORROW First Tiger, now Angel. How many gay porn stars will fill the posthumous headlines surrounding hedge funder and CNBC contributor Seth Tobias? "Angel … had a thing for trimming Tobias' hair - and not on his head. Former Tobias employee Bill Ash tells us that Tobias' wife, Filomena, was cool with her husband's tonsorial hobby. He's married) Andrew Ross Sorkin for making it all the way to the fifth paragraph before saying "cocaine binge with a promise of sex with a male go-go dancer known as Tiger." It's all in his story about Seth Tobias, the rilly-wealthy hedge fund manager and CNBC talking head who was found dead in September, face down in the pool of his tony Florida estate.
